1. Definitions
In these Terms and Conditions, the following terms have the meanings set out below:
- "Naga Law", "we", "us", "our" — the legal practice operating from 198 Ekkamai Road, Khlong Tan Nuea, Watthana, Bangkok 10110, Thailand
- "Service" — the pension legal services offered by Naga Law, as described on this website
- "Client", "you", "your" — any individual who engages Naga Law or accesses this website
- "Agreement" — these Terms and Conditions together with any written scope agreement entered into between the parties
- "Website" — the website operated at nagalawa.info
2. Acceptance of Terms
By using this website or engaging Naga Law's services, you agree to be bound by these Terms and Conditions. If you do not accept these terms, please do not use this website or engage our services.
Our services are available to individuals aged 18 and over who have the legal capacity to enter into a binding agreement. By engaging us, you confirm that you meet this requirement.
3. Description of Services
Naga Law provides three categories of pension legal service in Thailand:
- Pension Document Audit — independent review and written summary of pension documentation
- Administrative Appeal Representation — full representation through the administrative appeal process for disputed pension determinations
- Long-Service and Special-Status Pension Counsel — counsel and submission preparation for clients with special-status entitlement categories
Each service is described in further detail on our Solutions page. Services are available to clients located in Thailand. Geographic restrictions may apply in specific circumstances.
4. Engagement and Scope
No legal engagement exists until a written scope agreement has been signed by both parties. Enquiries submitted through the website or by telephone do not constitute an engagement.
The written scope agreement will set out: the specific service to be provided; the agreed fee; the estimated timeline; and any conditions or limitations applicable to the matter. Work may not begin before that agreement is in place.
Any extension of scope requires a separate written agreement.
5. Fees and Payment
Fees are as stated on this website and in the written scope agreement. All fees are quoted in Thai Baht (฿) and are inclusive of applicable taxes unless otherwise stated.
- Pension Document Audit: ฿3,200 per appointment
- Administrative Appeal Representation: ฿6,200 per matter
- Long-Service & Special-Status Pension Counsel: ฿8,300 per matter
Payment terms will be set out in the written scope agreement. We accept bank transfer and, where available, other payment methods as agreed. Fees are not contingent on the outcome of any matter.
6. Client Responsibilities
To allow us to conduct your matter effectively, you agree to:
- Provide accurate and complete information to the best of your knowledge
- Supply requested documents promptly and in the format requested
- Inform us promptly of any changes to your circumstances that may affect the matter
- Not provide false or misleading information to us or to any authority on whose behalf we act
7. Confidentiality
All information and documents provided to us in the course of an engagement are held in strict confidence. We will not disclose your information to any third party except as required to conduct the matter (for example, correspondence with a pension authority on your behalf) or as required by law.
Confidentiality obligations survive the conclusion of any engagement.
8. Intellectual Property
All written documents, summaries, appeal submissions, and other materials prepared by Naga Law in the course of an engagement are provided for the client's use in connection with that matter. They may not be reproduced, published, or shared for other purposes without our prior written consent.
All content on this website — including text, design, and structure — is owned by Naga Law and may not be reproduced without written permission.
9. Disclaimers
Legal services are provided on the basis of information available at the time of the engagement and in accordance with Thai law as it stands at that time. We do not warrant any particular outcome in any matter.
The content on this website is for general information only and does not constitute legal advice. Engaging a service through this website does not create a legal relationship until a written scope agreement is in place.
10. Limitation of Liability
To the extent permitted by Thai law, our liability to you in connection with any engagement is limited to the fee paid for that specific service. We are not liable for indirect, consequential, or special damages.
Nothing in these terms limits liability for fraud, wilful misconduct, or any liability that cannot lawfully be excluded.
11. Termination
Either party may terminate an engagement by written notice. If you terminate after work has commenced, you will be liable for a reasonable proportion of the agreed fee reflecting the work completed to that point. We may terminate an engagement if you provide materially inaccurate information or fail to meet your obligations under Section 6.
Confidentiality obligations and intellectual property provisions survive termination.
12. Dispute Resolution
In the event of a dispute, we encourage you to contact us directly in the first instance so that we may seek to resolve the matter informally. If informal resolution is not possible, disputes shall be resolved in accordance with Thai law, with the courts of Bangkok having jurisdiction.
13. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the Kingdom of Thailand. The Consumer Protection Act B.E. 2522 and other applicable Thai consumer and professional standards apply where relevant.
14. Changes to These Terms
We may update these Terms and Conditions from time to time. Changes will be posted on this page with an updated effective date. Continued use of this website or our services following such changes constitutes acceptance of the revised terms.
